MINUTES OF ST. MARYS CITY COUNCIL

ROLL CALL: Willoughby, Ginter, Slemmons, Kleinhenz, Harris, Bernard, Vossler.

 

Motion by Mr. Slemmons, second by Mr. Vossler to approve the minutes of the July 28, 2008,

meeting. Motion passed unanimously.

 

REPORTS OF CITY OFFICIALS STANDING COMMITTEES SPECIAL COMMITTEES:

 

The Mayor 's Monthly Report was presented. The Mayor also noted the new ladder truck had

arrived.

The Tax Commissioner's Monthly Report was presented.

The Safety-Service Director's Report was presented.

 

Safety

Mr. Bernard presented a report from the Safety Committee Meeting of August 4, 2008. Discussed

Dangerous Dogs, Dogs At-Large, Dog Waste, Etc. (1) Dog Feces - It was decided that dog feces

would be considered the same as other waste and owners could be cited for allowing their dogs to

deposit feces on others' property. Legislation is to be brought to Council. (2) Administrative Board

of Appeals - It was agreed that legislation should be brought to Council to establish a Board whereby

citizens who are cited under various sections of City Code will be able to have their case heard by

an Administrative Board of Appeals who shall be appointed by the Mayor. (3) Dogs At-Large -This

matter was put on hold. The Chief of Police and Dog Warden said they would work together to

attempt to resolve this problem. (4) Dangerous Dogs -Kraig Noble, Law Director, will prepare

updated legislation for City Council. Russ Bailey, Dog Warden, said he is to get a list of registered

pit bulls. Once he has this in hand, he will comb the county to be sure owners are in compliance

with laws regarding pit bulls and/or vicious dogs. Mr. Bailey noted if a dog is any part pit bull, it

is a pit bull. (5) Leash Law -This matter was debated among committee members and other Council

members present. Though there was not a consensus among committee members, any Council

Member can request legislation, and such legislation is expected to be brought before Council for

a complete vote of Council Members. (6) Auglaize County Humane Society -The committee

decided to discontinue our contract with the Humane Society.

Ms. Willoughby made a motion requesting the Law Director draft legislation that would add

language that dogs needed to be on a leash when off of owner's property. Discussion followed. Mr.

Ginter seconded the motion. YEA: Kleinhenz, Vossler, Slemmons, Willoughby, Ginter. NAY:

Harris, Bernard.

ADDITION OF THE CITY OF ST. MARYS

Motion by Mr. Kleinhenz, second by Mr. Slemmons to read Ordinance No. 2008-32 for a first

reading. Motion passed unanimously.

(Mr. Hitchcock noted this matter is contingent upon deed restriction.)

Motion by Mr. Kleinhenz, second by Mr. Ginter to read Ordinance No. 2008-34 for a first reading.

Motion passed unanimously.

 

Ordinance No. 2008-35 was presented to Council.

Motion by Mr. Ginter, second by Mr. Kleinhenz to read Ordinance No. 2008-35 for a first reading.

Motion passed unanimously.

 

Ordinance No. 2006-36

BUILDINGS

 

Motion by Mr. Vossler, second by Ms. Willoughby to read Ordinance No. 2008-36 for a first

A RESOLUTION OPPOSING THE CLOSING OF THE DEPUTY REGISTRAR OFFICE

IN THE CITY OF ST. MARYS

 

Motion by Ms. Willoughby, second by Mr. Vossler to read Resolution No.2008-19. Motion passed

unanimously.

 

Motion by Mr. Kleinhenz, second by Mr. Bernard to pass Resolution No. 2008-19. Motion passed

unanimously.

 

Resolution No. 2008-20 was presented to Council.

Motion by Mr. Vossler, second by Ms. Willoughby to read Resolution No. 2008-20 for a first

reading. Motion passed unanimously.

 

MISCELLANEOUS BUSINESS:

No Committee Meetings were scheduled for August 18th

 

Motion by Mr. Kleinhenz, second by Mr. Bernard to adjourn the meeting. Motion passed

unanimously. Council adjourned at 7:25 P.M.
